Schedules of dilapidations are normally served on Tenants by their Landlord or the Landlord’s representatives to advise the Tenant on breaches of their repairing obligations under their lease.
They usually are served prior to a Tenant giving notice to vacate, but may also be served on an interim basis during the lease term if the Landlord considers there is the need to.This can often occur when a tenant is looking to assign or sublet the property.
The extent of Tenants repair necessary will be determined by the terms of the lease, statute and any specific plans the Landlord may have for the future of the property which may mitigate the extent of claim.
